Terms of Service

1. Acceptance of Terms

By accessing or using War Machine ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Description of Service

War Machine is a marketing automation platform that provides tools for content generation, social media management, email automation, lead finding, SEO analysis, and website publishing. The Service assists users in creating and distributing marketing content.

3. Account Registration

To use the Service, you must:

  • Be at least 18 years of age
  • Provide accurate, current, and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. Subscription and Billing

4.1 Subscription Plans

Access to certain features requires a paid subscription. Subscription plans and pricing are available on our pricing page. We reserve the right to modify pricing with 30 days notice to existing subscribers.

4.2 Billing

Subscriptions are billed in advance on a monthly basis. Payment is processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial billing periods.

4.4 Free Trial

We may offer free trials for certain subscription plans. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights of others
  • Generate or distribute spam, malware, or malicious content
  • Harass, abuse, or harm others
  • Impersonate any person or entity
  • Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Attempt to gain unauthorized access to the Service or other systems
  • Interfere with or disrupt the Service or servers
  • Scrape, data mine, or collect information from the Service
  • Resell or redistribute the Service without authorization
  • Use the Service for any illegal or unauthorized purpose

6. Generated Content

The Service generates content to assist with your marketing efforts. You acknowledge and agree that:

  • Generated content may not always be accurate, complete, or appropriate
  • You are responsible for reviewing and editing all content before use
  • You are solely responsible for any content you publish or distribute
  • We do not guarantee that generated content is free from errors or biases
  • Generated content should not be relied upon for legal, medical, financial, or other professional advice

7. Third-Party Integrations

The Service allows you to connect third-party platforms (social media, email, analytics, etc.). Your use of these integrations is subject to the terms and policies of those third-party services. We are not responsible for the actions or policies of third-party services, and you use these integrations at your own risk.

8. Intellectual Property

8.1 Our Property

The Service, including its original content, features, and functionality, is owned by War Machine and is protected by copyright, trademark, and other intellectual property laws.

8.2 Your Content

You retain ownership of content you create or upload to the Service. By using the Service, you grant us a license to use, store, and process your content as necessary to provide the Service.

8.3 Generated Content

Subject to these Terms and your subscription, you own the content generated through the Service based on your inputs and prompts.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WAR MACHINE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless War Machine and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the United States.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and War Machine regarding the use of the Service and supersede all prior agreements and understandings.
